Carlsbad shooter ‘will be held accountable’ – Dumanis

SAN DIEGO (Press Release) — District Attorney Bonnie Dumanis announced on Friday a jury has found Carlsbad school shooter Brendan O’Rourke sane at the time he shot children seriously injuring two girls at Kelly Elementary School in October 2010.

“The community was deeply shaken by this school shooting and today’s verdict means the defendant will be held accountable for his crimes,” DA Dumanis said. “Deputy District Attorney Summer Stephan, Pat Espinoza and a dedicated team did an outstanding job presenting the evidence to the jurors during this phase of the trial, including testimony from expert witnesses.”

On March 5, the same jury found O’Rourke guilty of seven counts of attempted murder and five counts of assault with a firearm. Jurors immediately moved in the sanity phase of the trial, deliberating for seven hours before deeming him to be sane at the time of the shooting.

O’Rourke faces up to 103 years-to-life in state prison. He is scheduled to be sentenced on April 20, 2012 at 9:30 a.m. in Department 24 of the Vista Superior Court.
