Boxer lauds FDA plan to regulate e-smokes

WASHINGTON, D.C  (Press Release)– U.S. Senator Barbara Boxer (D-CA) responded Thursday, April 24,  to the announcement by the Food and Drug Administration (FDA) that it is moving to expand its authority to regulate tobacco products to include electronic cigarettes. The rule proposed by the FDA would allow the agency to regulate e-cigarettes, which are not currently under FDA jurisdiction, and would also subject e-cigarettes to many – but not all – of the same federal regulations that currently apply to traditional cigarettes, including: banning sales to children under 18, requiring disclosure of product ingredients, and prohibiting manufacturers from claiming their products are less harmful than traditional cigarettes without scientific evidence supporting their claims.

“Stopping the sales of these products to minors is a critical step that will help protect our children from a lifetime of nicotine addiction,” Senator Boxer said. “The FDA was also right to propose barring e-cigarette companies from making unproven health claims and requiring them to disclose the harmful ingredients in their products.”

“Now it is time for the Administration to take the next important step by banning the outrageous marketing of e-cigarettes to our kids, including the use of candy flavors and cartoon advertisements that are shamelessly designed to lure and addict them,” Senator Boxer said.

In February, Senator Boxer introduced the Protecting Children from Electronic Cigarette Advertising Act to prohibit the marketing of e-cigarettes to children and teens. The bill has been endorsed by the American Public Health Association, the American Academy of Pediatrics, the American Heart Association, the American Lung Association, the American Cancer Society Cancer Action Network and Campaign for Tobacco-Free Kids.

Earlier this month, Senator Boxer led a letter along with Senators Richard Blumenthal (D-CT), Dick Durbin (D-IL), Tom Harkin (D-IA), Edward J. Markey (D-MA) and Sherrod Brown (D-OH) urging the Federal Trade Commission (FTC) and the FDA to take enforcement action against e-cigarette manufacturers who make unsubstantiated or false claims in their advertising, including unproven assertions that their products help smokers of conventional cigarettes quit.
